3. User Accounts and Authentication

3.1 Account Creation

To access our services, you must create an account using Google OAuth authentication. By creating an account, you represent and consent that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• All information you provide is accurate and complete
• You will maintain the security of your account credentials
• You agree that by signing up, your data may be stored and used for promotional, marketing, and job-related email updates as described in Section 5

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited activities.

4. Acceptable Use Policy

• Generating tailored resumes and cover letters for job applications
• Receiving AI-powered recommendations for resume improvement

4.2 Prohibited Uses

• Upload resumes or content that you do not own or have permission to use
• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or hack the Service
• Exceed rate limits or attempt to overwhelm our systems
• Share your account credentials with others
• Use automated tools to access the Service without permission
• Upload malicious content, viruses, or harmful code
• Violate any applicable laws or regulations

5. Data and Privacy

5.1 Data Processing

By using our Service, you acknowledge and agree that:

• We will process and store your resume content, job descriptions, and related information by default to provide and improve our services
• Your data may be used for promotional and marketing purposes, including sending job updates, product announcements, and related communications to your registered email address
• Your data may be processed by third-party AI services (OpenAI) for analysis and generation
• We implement appropriate security measures to protect your data
• Our data practices are governed by our Privacy Policy

5.2 Data Retention

Resume content is only stored if you explicitly choose to save it. Otherwise, content is processed and discarded immediately. ATS analysis results and activity logs are retained as described in our Privacy Policy.

5.3 Data Deletion

You can request deletion of your data at any time by contacting us at support@speeduphire.com or by deleting your account through the platform.

6. Rate Limiting and Fair Use

To ensure fair access and system stability, we implement rate limiting:

• Rate Limit: Maximum 3 requests per minute per user
• Purpose: Prevent system abuse and ensure service availability
• Enforcement: Temporary blocking for users exceeding limits
• Fair Use: Use the Service reasonably and in good faith

7. Intellectual Property

The Service, including its design, functionality, algorithms, and content, is owned by SpeedUpHire and is protected by intellectual property laws.

You retain ownership of your resume content and personal information. By using our Service, you grant us a limited license to process your content solely for providing our services.

7.3 Generated Content

AI-generated content (tailored resumes, cover letters, recommendations) is provided to you for your use. You are responsible for reviewing and verifying the accuracy of generated content.

8. Service Availability and Modifications

We strive to maintain high service availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

9. Disclaimers and Limitations

9.2 AI-Generated Content

AI-generated content is provided as suggestions and recommendations. You are responsible for:

• Reviewing and verifying all generated content
• Ensuring accuracy and truthfulness of information
• Customizing content to match your actual experience
• Compliance with job application requirements

9.3 Third-Party Services

Our Service integrates with third-party services (OpenAI, Google, Supabase). We are not responsible for the availability, performance, or policies of these third-party services.

10. Limitation of Liability

To the maximum extent permitted by law, SpeedUpHire shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or use of our servers
• Damages resulting from any conduct or content of third parties
• Damages resulting from job application outcomes or hiring decisions

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
